Californians facing increased tax burdens, due to canceled or forgiven debts, have been granted some relief by way of a mortgage relief act extension. The Mortgage Forgiveness Debt Relief Act of 2007 has been extended to help aid homeowners. The act offers a tax break for those who are deeply affected by losses, due to the recent housing crisis.
Under normal circumstances, if a mortgage or other loan is canceled, or otherwise forgiven, the government considers that amount to be a taxable income. This would include any qualifying debt that is acquired through the purchase of a home , as well as constructing, substantially improving a primary residence or refinancing for those purposes.
Many people in the state received cancellations of this kind of debt, due mainly to foreclosures, short sales and other forms of loan modifications. This housing relief program allows a mortgage debtor to be free of certain taxation. These exclusions formerly applied only to qualifying debts that were forgiven in the years 2007 through 2009. This new extension of the law will apply to debt that is discharged on, or after January 1, 2010.
The program is set to help thousands of troubled borrowers by awarding home loan modification, insurance to different types of mortgages, and may even provide opportunities to refinance mortgage rates. The Department of Treasury claims that the FHA has been given a 300 billion US dollars worth of budget in order to provide foreclosure relief to American homeowners across the country.
Enhances mortgage disclosures requirements to require lenders to inform borrowers of the maximum monthly payments possible under their loans. Provides additional funding for housing counseling and legal services to distressed borrowers. 44 billion will be provided for emergency Community Development Block Grant money to purchase and clean up abandon homes in areas blighted by foreclosures.
